Microsoft has just launched the new Windows 8 with a completely refreshed design and yet the company is already being sued for patent infringement over its Windows 8 Live Tiles. A Maine (U.S.) based company named Surfcast alleges that it holds the patent of the concept of Live Tile, one of the dominant new features in Windows 8.

Surfcast stated on the company’s website that they developed the concept of Tiles in 1990’s. The company alleges that Microsoft “had knowledge of the 403 patent at least as early as April 21, 2009” and deliberately copied the patent. It is seeking monetary damages related to contributory infringement and the “direct willful infringement”.

According Mandour & Associates, Microsoft states that it has its own patent that covers the Live Tile technology. The company released a statement that said “we are confident we will prove to the court that these claims are without merit and that Microsoft has created a unique user experience”.
