Samsung Sues Apple’s iPhone 5 and Allowed to Sell Galaxy Tab in US

Samsung filed a motion in a U.S. court on Tuesday adding the iPhone 5 to the patent infringement lawsuit against Apple.

The Korean technology giant alleges that Apple’s iPhone 5, iPad 3, iPad 2, iPhone 4S, iPhone 4 and iPod touch of infringing eight of its patents. Samsung stated: “…we have little choices but to take the steps necessary to protect our innovations and intellectual property rights,” Reuters reports.

Samsung warned before the launch of the iPhone 5 that it would file a lawsuit against Apple if the iPhone 5 had LTE capabilities. To justify adding the iPhone 5 to the previous filing, Samsung states in its amendment that it “could not have known whether the rumored iPhone 5 would practice its patented technologies when it filed its infringement contentions on June 15. The product was not on the market at that time and could not have been included in the contentions.”

Reuters reports on Monday that the temporary injunction of Samsung’s Galaxy Tab 10.1 sales in U.S was lifted. “We are pleased with the court’s action today, which vindicates our position that there was no infringement of Apple’s design patent and that an injunction was not called for,” Samsung said in a statement.
